Under Utah law, an operator of an agritourism activity or the property where the activity takes place is not liable for the injury, illness, death, or damage to personal property of a participant that primarily results from the inherent risks of the activity or a participant's failure to follow instructions or exercise reasonable caution. You are assuming the risk of participating in or observing an agritourism activity.
This notice is provided pursuant to Utah law and is not intended to limit any liability or responsibility that cannot legally be limited or waived.
4. INHERENT RISKS OF LIVESTOCK & FARM ANIMAL ACTIVITIES
Evans Acres Mini Farm is a working farm where guests may observe or, when specifically permitted, interact with livestock and other farm animals.
Animals are unpredictable. Participant acknowledges and understands that being near, observing, feeding, touching, handling, or otherwise interacting with livestock and farm animals involves inherent risks that cannot be completely eliminated.
Livestock and farm animals may react unexpectedly to sounds, sudden movements, unfamiliar people or objects, other animals, weather, food, changes in their environment, or other circumstances. An animal may bite, kick, buck, charge, butt, push, step on, knock over, scratch, run into, or otherwise cause injury or property damage. Even an animal that is normally calm, friendly, familiar, or accustomed to people may react unexpectedly.
Inherent risks associated with farm animal and livestock activities may also include collisions with other animals or objects and injuries resulting from a participant's own actions or the actions of another participant.
By entering or participating in an activity at Evans Acres Mini Farm, Participant acknowledges these inherent risks and agrees to:
-
Exercise reasonable caution;

Follow all posted signs and instructions;
-
Follow all directions given by Evans Acres staff or representatives;

Maintain a safe distance from animals when instructed;
-
Not intentionally startle, chase, corner, grab, climb on, or otherwise provoke an animal; and
-
Immediately report any unsafe condition, animal behavior, injury, or incident to Evans Acres staff.
Nothing in these Terms & Conditions is intended to waive, limit, or eliminate any rights, protections, duties, or liabilities established by applicable Utah law.
5. LIVESTOCK & ANIMAL SAFETY RULES
Animals are animals—not exhibits or toys.
Guests must treat all animals with respect and may not:
-
Chase or intentionally startle an animal;
-
Corner, trap, or block an animal's movement;

-
Enter an animal enclosure without permission;
-
Feed an animal unless feeding is specifically permitted by Evans Acres; or
-

To the extent permitted by applicable Utah law, you agree to release and hold harmless Evans Acres Mini Farm, LLC, its owners, members, employees, agents, volunteers, and representatives from claims arising from injuries, illness, death, or property damage resulting from inherent risks of the activities or from your failure to follow instructions or exercise reasonable caution.
